So I sent some parts for powder coating a while back. It was gonna take time since some of thier equippment needed repairs and I had to wait for my color but the price was good and I wasnt in a hurry. Besides... I knew the guy well, as I was a frequent customer. I made a turn once in a few weeks... until I find the place is closed.
The business went down and are about to be liquidated, but my parts are still locked inside. I failed to get a hold of the guy, I speak to the manager of the building but he cant help me and gives me a number of the lawyers.
The lawyer says I have to wait for the court to appoint Liquidators.

The parts havent been powder-coated yet.
I have got photo's to prove the parts belong to me but no slip.
Will I need a court order? and how do I get one?

You will have to approach the liquidators and either submit a claim as a creditor for the full value of the parts or ask em nicely to release the parts as you can prove they are NOT an asset/stock of the company that went belly up. This could take YEARS!!! As a creditor you are buggered , you will be last on the totem pole re a payment. (sars , liquidator. bank, labour all ahead of you)
Prior to liquidators being appointed you have a far better chance of recovery without legal hassles , speak to the "lawyers" and appeal to em - stating you are an innocent victim and the said parts are basically worthless to the co and are priceless to you. All depends who closed the co down - if it was voluntary - the owner should still have access and he himself could maybe release the parts.

I doubt the closure was voluntary...
I will appeal to the lawyer, but just incase, I managed to get a court order today, it was fairly easy.
Will see the laywer on Monday.

This is not the first time I've had parts lost/damaged from sending them in :x
So this time I'm taking no prisoners :evil:

Ironic - the very time you need a building 'burgled' in SA no-one goes near it! :mrgreen: Now I'm not suggesting anyhting..........................

Have exactly the same problem.

Sent 2 1600 VW cylinder heads to be sandblasted, guys phone is off, went there and everything is closed...Spoke to the neighbours and he reckons that him and his wife have skipped the country because they were running some kind of racket. So now I'm up shit creek without a paddle...

Will be speaking to my lawyer today... :x
